Progress with resolution of PAUP appeals in the Environment Court as at 20 February 2019
Of the 67 PAUP plan appeals lodged in the Environment Court in September 2016, 58 have now been disposed of, the majority through settlement or withdrawal following mediation.
The following topics are currently on hold pending further action to progress them:
- PAUP - 011/057/064 - RPS Rural – Subdivision topic (7 appeals). This topic has been appealed to the High Court. A decision is pending.
- PAUP - 080/081 - Rezoning and Precincts - 56 Fairview Avenue and 129 Oteha Valley Road (1 appeal). This topic is awaiting reconsideration by the Independent Hearings Committee following a Court of Appeal decision.
- PAUP - 080/081 - Rezoning and Precincts - Redhills Precinct (1 appeal from 2016 and two from 2017).
One appeal that was lodged in 2017 following a High Court decision granting a right of appeal to the Environment Court is in the process of being timetabled to a hearing topic (PAUP - 075 - Waitakere Ranges - Heritage Area).
One appeal that was lodged in 2018 following a High Court decision granting a right of appeal to the Environment Court has been timetabled to a hearing (topic PAUP - Significant Ecological Areas overlay - Brookby Quarry).

Judicial directions and decisions
Following an application by the Auckland Council, the Court has made waivers and directions applying to any appeals lodged under section 156(1) or (3) of the Local Government (Auckland Transitional Provisions) Act 2010. Both the application and the Court's decision granting the waivers and directions can be viewed below.
Please note the the above waivers and directions do not apply to appeals under section 157 of the Local Government (Auckland Transitional Provisions) Act 2010.
